General Terms and Conditions 
  1. Brokerage
    CarDelMar arranges the rental of vehicles in many locations at competitive prices. The rental agreement is concluded with the local rental company under their terms and conditions. Please note the information given on our voucher and documentation.

    2. What’s included?
    a) Basic Package:

    The prices quoted include the following:
    - Unlimited mileage
    - Third party insurance (the extent of the indemnity is limited in accordance with the terms and conditions of the local rental companies or additional coverage taken out through the local rental company: see clause 20 below)

    b) Inclusive Package: comprehensive coverage with deductible

    The prices quoted include the following:
    - Unlimited mileage
    - Third party insurance (the extent of the indemnity is limited in accordance with the terms and conditions of the local rental companies or additional cover taken out through the local rental company: see clause 20 below)
    - Comprehensive and vehicle theft cover with deductible
    - Airport taxes and delivery, together with any other local taxes where applicable, unless provided otherwise in the conditions contained in the documentation or voucher.
    - see clause 2d for exclusions

    c) Inclusive Plus Package: comprehensive coverage with no deductible

    The prices quoted include the following:
    - Unlimited mileage
    - Third party insurance (the extent of the indemnity is usually limited in accordance with the terms and conditions of the local rental companies or additional cover taken out through the local rental company: see clause 20 below)
    - Comprehensive and vehicle theft cover with no deductible
    - Airport taxes and delivery, together with any other local taxes where applicable, unless provided otherwise in the conditions contained in the documentation or voucher
    - see clause 2d for exclusions

    d) The above mentioned prices do not include:

    -
    Fuel: a deposit  is often payable for fuel and is usually refunded if the car is returned with a full tank. Please review the supplier’s fuel policy at pickup – policies vary by supplier
    - Parking fees, tolls, congestion charges, parking and traffic fines
    - Additional drivers charges where applicable
    - Delivery and pickup charges where applicable
    - Charges for pickup and dropoff of the vehicle outside of the rental location’s standard hours of operation
    - Optional extras (child seats, ski racks etc.)
    - One-way rental charges where applicable
    - Young drivers charges where applicable

    3. Prices
    All prices quoted are in USD and include VAT. Please note of the period of time for which the prices quoted are valid. Special offers can not be combined.

    5. Obligation of the client
    It is your obligation to attend to the status of your E-mail account capacity and to consequently make sure incoming E-mails are well delivered at anytime. It is your obligation to ensure your E-mail account capacity allows you to be notified about incoming E-mails at the time these are sent. We can NOT be held responsible for any damages incurred from any E-mail account capacity limitations you may be faced with and which should have been prevented by yourself. Your E-mail account capacity remains your sole responsibility.

    6. Payment
    Payment can only be made by credit card. CardelMar debit your credit card for the full amount of the booking at the time your booking is made. For all on request bookings, please note that we will debit your credit card on confirmation date of your booking.

    7. Reservation by vehicle group

    8. Rental Contract
    The rental contract is concluded locally with the local rental company. Please read the rental agreement carefully and keep a copy for reference.

    9. Rental Period
    The vehicle can only be rented for complete days. A rental day is the time period 24 hours from the collection of the rental vehicle. Vehicles must, therefore, be returned at the same time of day as they were collected. Please note: if the period of rental has been exceeded, the additional time will be charged at a rate set by the local rental company and not at the special rate at which the original booking was made. Please note that no refund will be possible in the case of an early drop off of the vehicle.

    10. Cancellation of the reservation or non-collection of the vehicle
    You can cancel your booking with CarDelMar up to 24 hours before the start of the rental period. The full agreed price shall be paid if the reservation is cancelled during the 24 hours before the agreed time of collection or if the vehicle is not collected.
           We only guarantee refund before the 24 hrs. when cancellacion is made directly  
  •            with CardelMar via their toll free hotline  1866 2983838  . If you make a cancellation, you will receive a copy of the cancellation order for your records.


    Please Note: Should the vehicle not be picked up on the date stipulated, the availability of the vehicle cannot be guaranteed as the local car rental company has the right to otherwise reserve the vehicle for hire.  In this case there is no right to a refund of the cost of the car rental. 

    The customer may also provide proof that full payment of the rental charge, in the event of cancellation of the reservation or non-collection, has caused a loss.
     
    11. Reservation Amendments
    All changes to a reservation require confirmation from the local rental company. It is not generally possible to change a reservation less than 24 hours before the agreed collection date. We will, however, endeavour to process any amendments you may make, subject to availability.

    You can extend your reservation by contacting the call centre of Car del Mar at least 24 hours before the end of the agreed rental period. If you agree the extension locally with the local rental company, we cannot guarantee that the extension will be offered on the same special terms as the original booking. The local rental company is entitled to charge their own rates.

    Please inform us immediately of any alterations that directly affect the planned collection of the rented vehicle, e.g. change of arrival time at the collection point.

    12. Vehicle Collection
    The rented vehicle is usually collected from your destination airport or alternatively from a collection point, with a free shuttle service to take the customer from the airport to the collection point. If hotel delivery is possible or has been pre-agreed, there may be additional charges, depending on the terms and conditions of the local rental company.

    13. Repairs
    In the event of an accident or breakdown, please inform the local rental company immediately. Repairs should never be made to the rental vehicle without permission.

    14. Extras
    Additional accessories such as child safety seats, snow chains etc. are available, at extra charge, from many local rental companies.

    15. Driving License and Passport/ Identity Card
    Drivers must produce a valid drivers license (or in some cases an international driving license) Please note local requirements. Normally the driver and any additional drivers should have held a driving licence  for at least one year. In certain countries, drivers are required to have held a valid driving licence for at least three years. A valid passport or identity card must be presented when collecting the vehicle:
    PLEASE NOTE: Some local rental companies only allow an additional driver to be included on the payment of a surcharge.

    16. Minimum Age
    Some local rental companies demand a minimum age for all first and additional drivers. Please note the relevant advice.

    17. Deposit
    All local rental companies require a deposit. In this case a credit card is required. Please note the relevant advice.

    18. Refuelling
    There are three options for filling the fuel tank on return of the vehicle:
    1. Empty to empty – i.e. the fuel tank is empty when the rental car is collected and is to be returned empty.
    2. Full to full  i.e. the tank is full when the rental car is collected and is to be returned full.
    3. Full to empty – i.e. the tank is full when the rental car is collected and is to be returned empty.
    In this case the full tank of fuel must be paid for in advance, on collection.
    Please note which of the above options is quoted in your car rental company rental contact, in order to avoid any extra costs.

    19. One-Way Rental
    In many destinations, the rented vehicle can be dropped at a different station from that where it was rented, provided that the drop-off station is in the same country as the pick-up station. Please note any additional costs and the associated terms before reservation. One-way car rentals in Spain are possible ONLY if the car rental duration is of 3 days or more.

    20. Third Party Vehicle Insurance
    Please note that the third party insurance provided by many local rental companies has a limit on the indemnity. Please ask the local rental companies for their current indemnity limit. In the event of a claim where the amount of damage and/or loss (in respect of persons and property) exceeds the indemnity limit, the amount in excess of the limit is not covered.

    It is recommended that additional insurance with a higher indemnity limit is taken out with the local rental company Please note: The third party insurance does not cover any damage to the rented vehicle (see clause 21: the cover offered under the fully comprehensive insurance package). The insurance cover is also no longer valid, if the driver was under the influence of alcohol, drugs or medication rendering him/her unfit to drive.

    In the event of damage, the claimant must report the incident immediately, at the latest on the following day, to ensure that the insurance cover is not invalidated. The address to contact can be found in the insurance documentation.

    21. Comprehensive Cover
    The rental price quoted by CarDelMar includes fully comprehensive cover, or similar, in respect of damage to the rental car, together with theft insurance. Please read the information on the voucher relating to the scope of the cover and exclusions. If the local rental company only offers cover with an excess payable, it will retain the agreed deductible amount in the event of damage; this sum will be deducted from your deposit. The deductible shall be held by the local rental company and charged to your credit card. The amount of deductible differs from country to country. Please note the terms issued by the local rental company. In the case of damage, the deductible amount shall be deducted from your deposit and charged to your credit card. Consequential costs such as vehicle recovery fees, service fees, hotels, telephone charges etc. are not generally refunded. CarDelMar can not be held liable if total car hire period is hindered and/or reduced due to a vehicle breakdown.

    22. What to do in the event of loss and/or damage
    If you are injured or the vehicle is stolen you must
    - Immediately contact the local rental company
    - Inform the police and they will issue a police report.
    - When you return the rental car, ensure that the rental agency compiles a damage report that is to be signed by the local rental company and by you.

    23. Additional Insurance
    Most local rental companies offer additional insurance packages, in particular Personal Accident Insurance (PAI). The prices and terms of these additional insurance packages should be requested directly from the local rental company. CarDelMar cannot refund the cost of such additional cover.

    24. Guarantee
    As a broker, CarDelMar has no control over the contract terms offered by the local rental companies. CarDelMar is, however, prepared to intervene in the event of problems between the customer and the local rental company.

    25. Liability
    CarDelMar is liable for its own actions and performance in case of wilful misconduct or gross negligence. In cases of negligence, CarDelMar will only accept liability in cases of injury of the contract-substantial obligations. The liability of CarDelMar is to an extent limited to contract-defined and foreseen damages, and the maximum amount of liability is limited to the 10-time value of the contract with the local rental car company.

    The exclusions and limitations of liability mentioned above do not apply to damages resulting in loss of life, personal injury or harm to health.

    26. Acts of God/ Force Majeure
    CarDelMar cannot be held liable for Acts of God/Force Majeure. This includes war, unrest, aeroplane hi-jacking, terrorist attacks, all natural catastrophes, power cuts, strikes, lock outs and similar events.

    27. Place of Jurisdiction
    For all disputes arising from any aspect of this contract, Hamburg is the agreed place of jurisdiction, provided that you have no inland place of jurisdiction or that your place of residence has moved abroad after the conclusion of the contract or if your place of residence is unknown at the time of institution of legal proceedings.

    28. Country of Jurisdiction
    Your contract is subject to the laws of the Federal Republic of Germany.
